You must use the website in a lawful manner and comply with our Acceptable Use Policy. We may suspend or terminate access if you breach these Terms or our policies.

3) Products & pricing

Product images are illustrative. Colours, packaging and minor specifications may vary. Dimensions/weights are approximate unless stated as exact. Availability is subject to stock. We reserve the right to discontinue any item without notice.

Prices (VAT)

Unless stated otherwise, prices on the website are shown exclusive of VAT. Tolvia is not currently VAT-registered; therefore UK VAT is not charged on purchases. Should our VAT status change, prices and invoices may reflect VAT in the future.

Currency display

Prices can be displayed in multiple currencies for convenience: GBP, EUR, USD, AUD, CAD, NZD. Billing currency is GBP. Your card issuer may apply its own exchange rate and fees.

Errors & omissions

We may cancel or refuse orders where a pricing, availability or description error is identified. If payment was taken, you will receive a full refund.

4) Orders & contract formation

1. Order placement. When you submit an order, you receive an email acknowledgement — this is not acceptance.
2. Acceptance & contract. Your order is accepted, and the contract formed, when we email a dispatch confirmation and hand items to the carrier.
3. Fraud & verification. We may refuse any order (e.g., risk checks, address mismatch, out-of-stock).
4. Consumer rights. UK consumers retain statutory rights under the Consumer Rights Act 2015 and Consumer Contracts Regulations 2013 (see Returns section).

5) Payments & currencies

We currently accept Visa and Mastercard. By paying you confirm you are authorised to use the card and funds are available. All transactions are charged in GBP. If you view prices in EUR, USD, AUD, CAD or NZD, those are estimates—your card issuer’s exchange rate and fees apply.

We use secure, PCI-DSS-compliant acquiring services. For chargeback or unauthorised-use concerns, contact your card issuer and our support team.

6) Shipping & delivery

7) Returns & refunds

We want you to be happy with your purchase. How to return, time windows and conditions are explained in our Return & Refund Policy.

Consumer cancellation (distance selling)

If you are a UK consumer, you may cancel most online purchases within 14 days of delivery under the Consumer Contracts Regulations 2013. This is in addition to any extended store policy we provide. Items must be kept in reasonable condition and returned as instructed.

8) Warranty

Many electronic and power tool products come with a 12-month warranty covering manufacturing defects (misuse, wear & tear excluded). Warranty specifics and how to claim are set out in our Warranty Policy. Your statutory rights remain unaffected.

9) Promotions & promo codes

• Unless stated otherwise, promotions are time-limited, subject to availability and may be withdrawn without notice.
• One code per order, no cash alternative, non-transferable, valid only at tolvia.co.uk.
• Promotions cannot be applied to past orders and may exclude certain products/brands or shipping fees.

10) Liability

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited by law. Subject to the foregoing, we are not liable for: (a) indirect or consequential losses; (b) loss of profits, revenue, data or business; (c) delays or failures due to events beyond our reasonable control (force majeure).

If you purchase products for business use, our liability is limited to the price paid for the relevant products.

11) Intellectual Property

The website, brand names, logos, text, images and other materials are protected by intellectual property rights and remain the property of Tolvia/FERNROCK LIMITED or our licensors. You may not copy, scrape, modify, distribute or exploit any content without prior written permission.

12) Privacy & cookies

We handle your personal data in accordance with our Privacy Policy. Cookies and similar technologies are described in our Cookie Policy. Our cookie banner (CookieAdmin) lets you manage non-essential cookies.

13) Age, safety & compliance

• You must be 18+ to purchase power tools or other age-restricted goods.
• Always read and follow manufacturer instructions, use appropriate PPE and ensure safe operation.
• Where applicable, products meet UKCA/CE requirements as specified by the manufacturer.

14) Miscellaneous

• Assignment: We may transfer our rights/obligations under these Terms; this will not affect your statutory rights.
• Severability: If any clause is found invalid, the remainder still applies.
• Entire agreement: These Terms, together with linked policies, form the entire agreement concerning your use and purchases.
• Governing law: England & Wales. Courts of England & Wales have exclusive jurisdiction, subject to consumer protections.
• Complaints & ADR: We operate an internal complaints process via info@tolvia.co.uk. Where required by law we will provide information about alternative dispute resolution options.
